Applicable from: 29.07.2026.<\/strong><\/p>\n\n\n\n

By accessing or using the services provided through the Partner Platform of a BlokDev partner (hereinafter<\/p>\n\n\n\n

referred to as the ‘partner platform ‘), <\/strong>you (“user”, “you” <\/strong>or “client”) <\/strong>agree to be bound by these General<\/p>\n\n\n\n

Terms and Conditions (“Terms”).<\/strong><\/p>\n\n\n\n

These Terms constitute a legal agreement between you and BlokDev AD.<\/strong><\/p>\n\n\n\n

(\u201cBlockDev\u201d, \u201cwe\u201d, \u201cus\u201d, \u201cthe Company\u201d), <\/strong>a company incorporated under the laws of the Republic of Bulgaria<\/p>\n\n\n\n

(company number 208043482), <\/strong>with its registered office at 9A Positano Street, Office 12, Sofia 1000, Bulgaria<\/strong><\/p>\n\n\n\n

These General Terms and Conditions govern the use of the cryptoasset services provided by BlockDev AD<\/p>\n\n\n\n

through a partner platform, including, where applicable and within the permitted regulatory scope of BlockDev<\/p>\n\n\n\n

AD: exchange of cryptoassets for funds, exchange of cryptoassets<\/p>\n\n\n\n

against other cryptoassets, transfer of cryptoassets on behalf of clients and<\/p>\n\n\n\n

custody and administration of crypto assets on behalf of clients.<\/p>\n\n\n\n

The Partner Platform provides the client interface, technical integration and channel for submitting instructions,<\/p>\n\n\n\n

but this does not change the role of BlokDev AD as the provider\/principal of the relevant crypto asset service,<\/p>\n\n\n\n

when such service is provided by BlokDev AD. BlokDev AD is responsible for the applicable obligations in<\/p>\n\n\n\n

relation to crypto asset services, including service transparency, RFQ quotation, exchange\/transfer execution,<\/p>\n\n\n\n

custody and administration, where applicable, AML\/CFT\/KYT checks, sanctions screening, transaction<\/p>\n\n\n\n

monitoring, TFR\/Travel Rule enforcement, record keeping, client<\/p>\n\n\n\n

disclosures and customer protection.<\/p>\n\n\n\n

For the avoidance of doubt, payment services, payment accounts, electronic money, open banking services,<\/p>\n\n\n\n

card payments, bank transfers, VIBAN services or other regulated payment functionalities are only provided by<\/p>\n\n\n\n

the relevant licensed payment provider, electronic money institution, bank or other regulated partner, unless<\/p>\n\n\n\n

BlokDev AD expressly has an applicable regulatory status to provide such service. In such cases, BlokDev AD<\/p>\n\n\n\n

acts only in the applicable capacity, including as an agent\/registered representative, where relevant.<\/p>\n\n\n\n

USDC, EURC and other electronic money tokens \/EMT\/ are not provided by BlockDev<\/p>\n\n\n\n

as part of transfer, custody or administration services, unless otherwise expressly provided for in the future<\/p>\n\n\n\n

under the necessary regulatory basis,<\/p>\n\n\n\n

updated client documentation and separate client acceptance.<\/p>\n\n\n\n

By using the Partner Platform to access these services, you acknowledge and agree to comply with all provisions<\/p>\n\n\n\n

set forth in these Terms.<\/p>\n\n\n\n

Please read these Terms carefully as they contain important information regarding your rights and obligations,<\/p>\n\n\n\n

as well as limitations and exclusions of liability that apply to you when using the Services. If you do not agree to<\/p>\n\n\n\n

these Terms, you must immediately cease using or accessing the services provided by BlockDev through the<\/p>\n\n\n\n

Partner Platform.<\/p>\n\n\n\n

1. General provisions<\/strong><\/p>\n\n\n\n

1.1 The Role of BlockDev<\/strong><\/p>\n\n\n\n

The partner platform provides the client interface, the technical<\/p>\n\n\n\n

integration and the channel for submitting instructions, but this does not change the role and<\/p>\n\n\n\n

the responsibility of BlockDev AD as a provider of the relevant crypto asset service. BlockDev AD is responsible<\/p>\n\n\n\n

for the applicable obligations in relation to the services it provides, including service transparency, RFQ quoting,<\/p>\n\n\n\n

exchange\/transfer execution, AML\/CFT\/KYT checks, transaction monitoring, TFR compliance, record keeping<\/p>\n\n\n\n

and customer protection.<\/p>\n\n\n\n

All interactions with BlockDev services are carried out through the partner platform, which is responsible for<\/p>\n\n\n\n

the overall user experience and<\/p>\n\n\n\n

the provision of services.<\/p>\n\n\n\n

1.2 Services provided<\/strong><\/p>\n\n\n\n

The services provided by BlokDev AD through the partner platform may only include services that are within the<\/p>\n\n\n\n

applicable regulatory scope of BlokDev AD and are technically accessible through the respective partner<\/p>\n\n\n\n

platform. Depending on the configuration of the partner platform, the client profile,<\/p>\n\n\n\n

jurisdiction, supported assets and applicable restrictions, services may<\/p>\n\n\n\n

include:<\/p>\n\n\n\n

1. Exchange of crypto assets for funds \/on-ramp\/ <\/strong>\u2014 acquisition of a supported crypto asset against<\/p>\n\n\n\n

official currency, when the relevant payment flow is processed through a licensed payment partner,<\/p>\n\n\n\n

and BlockDev AD provides the crypto asset service within the applicable CASP regime.<\/p>\n\n\n\n

2. Exchange of crypto assets for funds \/off-ramp\/ <\/strong>\u2014 exchange of a supported crypto asset for an official<\/p>\n\n\n\n

currency, with the fiat payment being made<\/p>\n\n\n\n

through a licensed payment partner, where applicable.<\/p>\n\n\n\n

3. Exchange of crypto assets for other crypto assets <\/strong>\u2014 exchange between<\/p>\n\n\n\n

supported cryptoassets when the relevant service is available and enabled for<\/p>\n\n\n\n

the client.<\/p>\n\n\n\n

4. Transfer of crypto assets on behalf of clients <\/strong>\u2014 execution of<\/p>\n\n\n\n

instructions for transferring supported crypto assets, after performing<\/p>\n\n\n\n

applicable checks, including AML\/CFT, sanctions screening, KYT\/transaction verification, Travel Rule<\/p>\n\n\n\n

checks and internal limits.<\/p>\n\n\n\n

5. Custody and administration of crypto assets on behalf of clients<\/strong><\/p>\n\n\n\n

\u2014 only when this service is explicitly available to the respective client, is included in the applicable<\/p>\n\n\n\n

regulatory scope of BlokDev AD, the supported cryptoasset<\/p>\n\n\n\n

is included in the register of supported assets, the client has accepted the individual<\/p>\n\n\n\n

custody terms and conditions and relevant risk disclosures are provided.<\/p>\n\n\n\n

For the avoidance of doubt, BlokDev informs you that with regard to<\/p>\n\n\n\n

the service of administration and custody of crypto assets on behalf of clients, requires the conclusion<\/p>\n\n\n\n

of a standard agreement between BlokDev and the client. Acceptance of these General Terms and<\/p>\n\n\n\n

Conditions alone does not grant you access<\/p>\n\n\n\n

to the use of the crypto-asset administration and custody service.<\/p>\n\n\n\n

The services offered by BlokDev through the partner platform may include, but are not limited to:<\/p>\n\n\n\n

are not limited to:<\/p>\n\n\n\n

BlockDev supports on-ramp (from official currency (fiat) to cryptocurrency) <\/strong>and, where possible, off-ramp<\/strong><\/p>\n\n\n\n

(from cryptocurrency to fiat) <\/strong>transactions through the described<\/p>\n\n\n\n

payment methods below.<\/p>\n\n\n\n

\u00ff Card-to-crypto transactions (where possible): <\/strong>Allows users to purchase crypto assets using Visa and<\/p>\n\n\n\n

Mastercard payment cards, including tokenized card payments like Apple Pay and Google Pay.<\/p>\n\n\n\n

\u00ff Local\/alternative payment methods (where available): <\/strong>Allows users to fund purchases using local or<\/p>\n\n\n\n

alternative methods<\/p>\n\n\n\n

payment methods provided by one or more third-party payment partners.<\/p>\n\n\n\n

\u00ff Off-ramp payment methods (going from crypto to fiat currency where possible): <\/strong>Allows users to receive<\/p>\n\n\n\n

fiat payments to bank accounts and, where possible, to payment cards or through money transfer\/card payment<\/p>\n\n\n\n

systems (e.g. Visa Direct).<\/p>\n\n\n\n

1.3 Services provided through third parties<\/strong><\/p>\n\n\n\n

BlokDev may facilitate access to certain payment, open banking, banking, card, on-ramp\/off-ramp, settlement, custody<\/p>\n\n\n\n

infrastructure or other technical services.<\/p>\n\n\n\n

through licensed or registered third parties, including payment institutions, e-money companies, open banking service<\/p>\n\n\n\n

providers, banks, card acquiring institutions, payment processors, wallet\/technical infrastructure providers or other<\/p>\n\n\n\n

regulated partners.<\/p>\n\n\n\n

When a payment service, open banking service, fiat storage, payment account, card service, banking service or other<\/p>\n\n\n\n

regulated service is<\/p>\n\n\n\n

provided by a third party, such service is provided by the relevant third party under its applicable terms and conditions,<\/p>\n\n\n\n

tariffs, rules, policies and applicable national law. BlokDev is not considered a provider of such service unless explicitly<\/p>\n\n\n\n

otherwise stated and only within the scope of the applicable registration, license or agency.<\/p>\n\n\n\n

Before or upon using the relevant service, you will be informed via the Partner Platform, client interface, link, notice,<\/p>\n\n\n\n

check-box or other means.<\/p>\n\n\n\n

durable medium regarding: the nature of the service; the person providing it;<\/p>\n\n\n\n

the applicable general terms and conditions; the applicable fees; the applicable law; your fundamental rights; the<\/p>\n\n\n\n

procedure for submitting complaints; the deadlines for performance; the refund\/chargeback conditions, where<\/p>\n\n\n\n

applicable; and restrictions by country, payment method or customer profile.<\/p>\n\n\n\n

When the service is provided by a licensed financial institution, payment service provider, electronic money company,<\/p>\n\n\n\n

open banking provider or other<\/p>\n\n\n\n

regulated provider, customer rights in relation to this service are exercised in accordance with the terms and applicable<\/p>\n\n\n\n

law of the relevant provider. BlokDev will provide the information it has and will assist in directing the customer to the<\/p>\n\n\n\n

relevant provider or partner platform, when necessary.<\/p>\n\n\n\n

BlokDev does not accept deposits, does not issue electronic money, does not independently open payment accounts,<\/p>\n\n\n\n

and does not hold fiat funds of clients in its own capacity, unless and to the extent that it is duly licensed or registered<\/p>\n\n\n\n

to do so. When payment<\/p>\n\n\n\n

accounts, payment services or electronic money are available to the customer, they are provided by the relevant<\/p>\n\n\n\n

licensed provider or through the applicable agency\/partnership<\/p>\n\n\n\n

model.<\/p>\n\n\n\n

When BlockDev provides custody and administration services for crypto assets on behalf of clients, BlockDev remains<\/p>\n\n\n\n

the service provider to the client. For the technical storage, wallet infrastructure, signing,<\/p>\n\n\n\n

execution of validated instructions, technical records or other infrastructure elements BlokDev may use an external<\/p>\n\n\n\n

wallet\/custody infrastructure provider. Such external provider acts as a technical infrastructure provider and does<\/p>\n\n\n\n

not replace BlokDev as a service provider to<\/p>\n\n\n\n

the client.<\/p>\n\n\n\n

2. User access rights and account access<\/strong><\/p>\n\n\n\n

2.1 Criteria for right of access<\/strong><\/p>\n\n\n\n

2.1 Access rights requirements<\/p>\n\n\n\n

To access and use the services provided through the partner platform, you must meet the following access rights<\/p>\n\n\n\n

requirements:<\/p>\n\n\n\n

\u2022 You must be an adult, at least 18 years old or older<\/p>\n\n\n\n

of legal age under the laws of your jurisdiction.<\/p>\n\n\n\n

\u2022 You must be a resident of a jurisdiction where the use of transactions with<\/p>\n\n\n\n

cryptocurrencies and related services is permitted by applicable laws.<\/p>\n\n\n\n

\u2022 You must not be a resident or citizen of any of the restricted jurisdictions,<\/p>\n\n\n\n

as described below.<\/p>\n\n\n\n

\u2022 You have accepted these Terms and Conditions. Please note that we will not provide you with any services<\/p>\n\n\n\n

until you have agreed to and accepted these Terms and Conditions. In this regard, before logging into<\/p>\n\n\n\n

your account, a link to the Terms and Conditions will be visible to you, which you must read and<\/p>\n\n\n\n

acknowledge that you accept. By doing so, you agree to and accept the Terms and Conditions, after<\/p>\n\n\n\n

which you may be provided with a service from us.<\/p>\n\n\n\n

2.2 Limited jurisdictions<\/strong><\/p>\n\n\n\n

Access to the Services is prohibited to individuals and legal entities located in,<\/p>\n\n\n\n

are located in, registered with, or otherwise associated with countries or territories subject to sanctions, embargoes,<\/p>\n\n\n\n

or other restrictive measures by competent authorities, including but not limited to the U.S. Office of Foreign<\/p>\n\n\n\n

Assets Control (OFAC), the European Union, or other applicable national and international authorities. This<\/p>\n\n\n\n

includes jurisdictions subject to comprehensive sanctions regimes or substantial restrictions on financial services,<\/p>\n\n\n\n

cryptoassets, or payment transactions.<\/p>\n\n\n\n

BlokDev reserves the right, at its sole discretion, to refuse to provide services.<\/p>\n\n\n\n

or to restrict access to them to persons from such jurisdictions.<\/p>\n\n\n\n

By using the Services, you represent and warrant that you are not located, resident or established in a restricted<\/p>\n\n\n\n

jurisdiction, and that you are not acting on behalf of a person subject to sanctions or restrictions.<\/p>\n\n\n\n

In the event that BlokDev determines that you fall within the scope of the above restrictions, the Company has<\/p>\n\n\n\n

the right to immediately terminate or restrict your access to the Services, including by suspending or closing your<\/p>\n\n\n\n

account, without prior notice.<\/p>\n\n\n\n

2.3 Retraction for non-EU users<\/strong><\/p>\n\n\n\n

If you are not a citizen or resident of the European Union (EU), you acknowledge and agree that your use of the<\/p>\n\n\n\n

services provided by BlockDev is based on the principle of reverse solicitation. <\/strong>This means that you choose to<\/p>\n\n\n\n

access and use these services entirely on your own initiative, without any solicitation, advertising or marketing by<\/p>\n\n\n\n

BlockDev or its partners directed at you. By using the services, you confirm that you are<\/p>\n\n\n\n

fully aware of the legal and regulatory implications of accessing cryptocurrencies and financial services and that<\/p>\n\n\n\n

you do so voluntarily and at your own risk.<\/p>\n\n\n\n

2.4 Creating an account<\/strong><\/p>\n\n\n\n

To use BlokDev\u2019s services through the Partner Platform, you may be required to create an account on the Partner<\/p>\n\n\n\n

Platform. The account creation process may involve providing personal information, including identity verification,<\/p>\n\n\n\n

as part of Know Your Customer (KYC) requirements. By creating an account, you agree to provide accurate,<\/p>\n\n\n\n

complete, and truthful information. You are also responsible for maintaining the accuracy of the information in<\/p>\n\n\n\n

your account and for promptly updating it when necessary.<\/p>\n\n\n\n

You are solely responsible for safeguarding your login details and ensuring the security of your account. This<\/p>\n\n\n\n

includes maintaining the confidentiality of your username, password and any other authentication information.<\/p>\n\n\n\n

You are solely responsible for any activity that occurs under<\/p>\n\n\n\n

your account, including transactions initiated by third parties, whether or not<\/p>\n\n\n\n

are authorized or not, as a result of the failure to protect your login details.<\/p>\n\n\n\n

For the avoidance of doubt, BlokDev informs you that with regard to the service<\/p>\n\n\n\n

administration and custody of crypto assets on behalf of clients, a standard agreement between BlokDev and the<\/p>\n\n\n\n

client is required. Acceptance of these Terms and Conditions alone does not grant you access to the service.<\/p>\n\n\n\n

administration and custody of crypto assets.<\/p>\n\n\n\n

2.4 Account Responsibility<\/strong><\/p>\n\n\n\n

BlokDev is not responsible for unauthorized access to your account, transactions initiated due to improper handling<\/p>\n\n\n\n

or negligence in protecting your login details, or actions resulting from illegal or fraudulent activity initiated from<\/p>\n\n\n\n

your account. You agree to immediately notify the Partner Platform if you notice unauthorized access or suspicious<\/p>\n\n\n\n

activity in connection with<\/p>\n\n\n\n

with your account.<\/p>\n\n\n\n

2.5 Confirmation of the risks associated with cryptocurrencies<\/strong><\/p>\n\n\n\n

By intending to use services related to crypto assets, you declare that you are informed and understand the<\/p>\n\n\n\n

inherent risks associated with owning and trading crypto assets. These risks include, but are not limited to,<\/p>\n\n\n\n

significant fluctuations in the value of crypto assets, partial or complete loss of invested funds, technological and<\/p>\n\n\n\n

operational risks, cyber attacks, disruptions or malfunctions of distributed ledgers, and<\/p>\n\n\n\n

changes in the applicable regulatory environment.<\/p>\n\n\n\n

The Client bears the risk of losses arising from market movements, the characteristics and functioning of the<\/p>\n\n\n\n

relevant crypto-asset or the technology used, as well as from other circumstances beyond the reasonable control<\/p>\n\n\n\n

of BlokDev, except when the relevant loss is caused by an act or omission of BlokDev, for which the Company is<\/p>\n\n\n\n

liable under applicable law or these General Terms and Conditions.<\/p>\n\n\n\n

Nothing in this clause shall exempt or limit BlokDev from any liability that cannot be excluded or limited under<\/p>\n\n\n\n

applicable law, including for damage to or loss of crypto assets or funds where the relevant event can be attributed<\/p>\n\n\n\n

to BlokDev’s act or omission.<\/p>\n\n\n\n

BlokDev maintains insurance coverage for certain risks associated with<\/p>\n\n\n\n

the services provided, in accordance with the terms, limits, exclusions and other restrictions of the applicable<\/p>\n\n\n\n

insurance policy. When the event that occurred falls within the scope of this coverage, BlokDev takes the necessary<\/p>\n\n\n\n

actions to file and administer the insurance claim. The presence of insurance does not guarantee automatic<\/p>\n\n\n\n

payment of compensation to the client and does not extend BlokDev’s liability beyond that provided in the applicable<\/p>\n\n\n\n

legislation and the insurance policy.<\/p>\n\n\n\n

3. Transaction Execution and Risks<\/strong><\/p>\n\n\n\n

3.1 Transaction process<\/strong><\/p>\n\n\n\n

BlockDev facilitates the secure transfer of funds, performs the necessary conversions, and ensures the movement<\/p>\n\n\n\n

of assets between financial institutions, partners, and others.<\/p>\n\n\n\n

service providers, if any, involved in the transaction.<\/p>\n\n\n\n

Although BlockDev manages and executes transactions, all transactions are subject to the terms and conditions<\/p>\n\n\n\n

set by the partner platform. You acknowledge that the partner platform is responsible for facilitating your access<\/p>\n\n\n\n

to BlockDev services, including user account management and user interface maintenance.<\/p>\n\n\n\n

3.1.1 Payment methods<\/strong><\/p>\n\n\n\n

Depending on the configuration of the Partner Platform and your location, you may be able to use one or more<\/p>\n\n\n\n

funding or payout methods (\u201cPayment Methods\u201d), including bank transfer\/open banking, debit cards (Visa and<\/p>\n\n\n\n

Mastercard), tokenized card payments (Apple Pay and<\/p>\n\n\n\n

Google Pay) and other local or alternative payment methods provided through<\/p>\n\n\n\n

third partners.<\/p>\n\n\n\n

3.1.2 Availability; changes; third party partners<\/strong><\/p>\n\n\n\n

Payment method availability may vary by country\/corridor, bank\/card issuer, partner capabilities, and your risk<\/p>\n\n\n\n

profile. BlokDev may route transactions through one or more third-party providers (e.g., banks, payment service<\/p>\n\n\n\n

providers, open banking providers, card acquirers\/processors, and other partners) and may add, remove,<\/p>\n\n\n\n

suspend, or limit payment methods as necessary for compliance, fraud prevention, network\/partner policies, or<\/p>\n\n\n\n

risk management.<\/p>\n\n\n\n

3.1.3. Cryptoassets for use on the platform; technical address; custodial wallet<\/strong><\/p>\n\n\n\n

Where permitted by the Partner Platform and permissible under applicable law, the customer may acquire,<\/p>\n\n\n\n

exchange, transfer or use supported cryptoassets for purposes related to the Partner Platform, including<\/p>\n\n\n\n

payments.<\/p>\n\n\n\n

to merchants or other authorized transactions.<\/p>\n\n\n\n

USDC, EURC and other electronic money tokens \/EMT\/ are not provided by BlockDev<\/p>\n\n\n\n

as part of transfer, custody or administration services, unless otherwise expressly provided for in the future<\/p>\n\n\n\n

under the necessary regulatory basis,<\/p>\n\n\n\n

updated client documentation and separate client acceptance.<\/p>\n\n\n\n

Depending on the specific flow, the partner platform or BlockDev may create or provide a technical blockchain<\/p>\n\n\n\n

address for a limited purpose. Such<\/p>\n\n\n\n

technical address may only be used for execution or settlement of<\/p>\n\n\n\n

specific transaction and does not constitute a general client portfolio unless the client<\/p>\n\n\n\n

has expressly accepted the separate terms of custody and administration.<\/p>\n\n\n\n

When the client uses a cryptoasset custody and administration service on behalf of clients, BlockDev is the<\/p>\n\n\n\n

provider of this service to the client. In this case<\/p>\n\n\n\n

Client crypto assets are held and administered on behalf of the client through a custodial\/wallet infrastructure,<\/p>\n\n\n\n

which may be provided by an external technical provider. The external technical provider does not replace<\/p>\n\n\n\n

BlockDev as<\/p>\n\n\n\n

service provider to the customer.<\/p>\n\n\n\n

BlokDev maintains an internal register of client positions, applies rules for<\/p>\n\n\n\n

segregation of client assets, reconciles internal records, external provider data, and on-chain balances, and<\/p>\n\n\n\n

executes instructions only after necessary checks and approvals.<\/p>\n\n\n\n

The Client understands that in the case of a custodial service, he may not have access to the private keys<\/p>\n\n\n\n

associated with the technical wallet infrastructure. Access, management and execution of transactions are carried<\/p>\n\n\n\n

out in accordance with the procedures of BlokDev and<\/p>\n\n\n\n

the applicable custody conditions.<\/p>\n\n\n\n

The Client acknowledges that blockchain transactions are generally irreversible after<\/p>\n\n\n\n

confirmation that sending assets to an incorrect or unsupported address,<\/p>\n\n\n\n

an unsupported network or unsupported asset may result in permanent loss, and that BlokDev may refuse, delay,<\/p>\n\n\n\n

suspend or block a transaction due to AML\/CFT, sanction, KYT, Travel Rule, fraud, security, technical or<\/p>\n\n\n\n

regulatory risk.<\/p>\n\n\n\n

3.2 Transaction fees<\/strong><\/p>\n\n\n\n

Transaction fees may apply to any service provided by BlockDev, including but not limited to the processing of<\/p>\n\n\n\n

crypto-to-fiat, fiat-to-crypto, and crypto-to-crypto transactions. These fees will be disclosed by the partner platform<\/p>\n\n\n\n

prior to the completion of each transaction. You agree to pay<\/p>\n\n\n\n

all applicable fees associated with your transactions.<\/p>\n\n\n\n

3.2.1 Payment Method Fees; Card Transaction Classification<\/strong><\/p>\n\n\n\n

In addition to the fees of BlockDev or the partner platform, your chosen<\/p>\n\n\n\n

payment method may include additional fees charged by third parties (e.g. banks, card issuers, card networks,<\/p>\n\n\n\n

acquirers, processors, currency service providers or local payment partners). When you fund a purchase with a payment card, the<\/p>\n\n\n\n

transaction may be processed as an Account Funding Transaction (\u201cAFT\u201d) (or equivalent), where applicable,<\/p>\n\n\n\n

which may be treated differently by your card issuer than a standard retail purchase.<\/p>\n\n\n\n

3.2.2 Advanced Authentication \/ 3-D Secure<\/strong><\/p>\n\n\n\n

For some payment methods (including Open Banking and card payments) additional authentication (e.g. SCA<\/p>\n\n\n\n

and\/or 3-D Secure) may be required. You agree to complete all required authentication steps and acknowledge<\/p>\n\n\n\n

that failure to do so may result in the transaction being declined.<\/p>\n\n\n\n

3.2.3 Refunds, returns and reversals<\/strong><\/p>\n\n\n\n

All refunds, returns, reversals and cancelled transactions (including those related to card payments and AFT<\/p>\n\n\n\n

transactions) are processed<\/p>\n\n\n\n

according to the rules, procedures and deadlines of the relevant payment method, the applicable card scheme,<\/p>\n\n\n\n

the issuer of the payment instrument and\/or the relevant<\/p>\n\n\n\n

third party service providers.<\/p>\n\n\n\n

Requests for refunds or transaction disputes should be submitted through the official support channels of the<\/p>\n\n\n\n

Partner Platform. In this regard, you may be required to provide additional information, documents or evidence<\/p>\n\n\n\n

to support your request.<\/p>\n\n\n\n

In the event of a chargeback, return or cancellation of a transaction, the relevant amounts may be withheld,<\/p>\n\n\n\n

intercepted, adjusted or refunded.<\/p>\n\n\n\n

in accordance with applicable rules.<\/p>\n\n\n\n

3.3 Transaction confirmation<\/strong><\/p>\n\n\n\n

BlockDev is not responsible for delays or errors in the processing of transactions due to factors beyond its<\/p>\n\n\n\n

control, including network congestion, system crashes, or delays in blockchain confirmations. BlockDev will<\/p>\n\n\n\n

use reasonable efforts to process transactions in a timely manner, but does not guarantee that every<\/p>\n\n\n\n

transaction will be completed within a specific time frame.<\/p>\n\n\n\n

3.4 Risks<\/strong><\/p>\n\n\n\n

By using BlokDev’s services through the partner platform, you acknowledge that<\/p>\n\n\n\n

that cryptocurrency transactions carry inherent risks, including price volatility and risk of loss due to market<\/p>\n\n\n\n

fluctuations. BlokDev is not responsible for any financial losses arising from these risks, nor is it responsible for<\/p>\n\n\n\n

the performance of assets exchanged through the services. When the client uses a custody service<\/p>\n\n\n\n

and administration of crypto assets, there are additional risks, including the risk of a technological incident,<\/p>\n\n\n\n

cyberattack, operational outage, incorrect instruction, incorrect address or network, blockchain transaction delay,<\/p>\n\n\n\n

loss or compromise of access means, risk with an external wallet\/custody infrastructure provider, risk with forks,<\/p>\n\n\n\n

airdrops or network events, as well as the risk that the transaction will be delayed, refused or blocked due to AML\/<\/p>\n\n\n\n

CFT, sanctions, KYT, Travel Rule, fraud, security or technical considerations.<\/p>\n\n\n\n

BlokDev implements internal policies and controls to mitigate these risks, including segregation of duties,<\/p>\n\n\n\n

instruction approval, and control of<\/p>\n\n\n\n

access, monitoring, coordination and escalation of incidents, but cannot eliminate all risks inherent to cryptoassets,<\/p>\n\n\n\n

blockchain infrastructure and<\/p>\n\n\n\n

the use of external technology providers.<\/p>\n\n\n\n

3.5 Suspicious activity and compliance with regulatory obligations<\/strong><\/p>\n\n\n\n

BlockDev reserves the right to refuse, suspend or delay any transaction if it detects suspicious activity or if there<\/p>\n\n\n\n

is reason to believe that the transaction may be related to money laundering (ML), terrorist financing (TF) or other<\/p>\n\n\n\n

illegal activities. This includes transactions originating from blockchain addresses that have been flagged as<\/p>\n\n\n\n

potentially related to illegal activities, or if the transaction<\/p>\n\n\n\n

appears to be in violation of applicable laws or regulatory requirements.<\/p>\n\n\n\n

If BlockDev identifies a \u201ctainted\u201d or suspicious blockchain address, it may take action to block, suspend, or<\/p>\n\n\n\n

reverse the transaction. You acknowledge that BlockDev\u2019s decision to refuse or delay a transaction in such<\/p>\n\n\n\n

circumstances is at its sole discretion and that such action is taken in accordance with anti-money laundering<\/p>\n\n\n\n

(AML), counter-terrorism financing (CTF) and other applicable regulatory frameworks.<\/p>\n\n\n\n

3.6 No guarantee of completion<\/strong><\/p>\n\n\n\n

BlokDev does not guarantee the successful or timely completion of any transaction, especially when delays or<\/p>\n\n\n\n

errors occur due to circumstances beyond BlokDev’s control, such as technical problems with the blockchain,<\/p>\n\n\n\n

network congestion, or other third-party failures. BlokDev also reserves the right to<\/p>\n\n\n\n

refuse to provide services or fulfill transactions if there are concerns related to compliance, security, or suspicious<\/p>\n\n\n\n

activity.<\/p>\n\n\n\n

3.7 User responsibility<\/strong><\/p>\n\n\n\n

You are solely responsible for ensuring that the information provided during the transaction process, including<\/p>\n\n\n\n

wallet addresses and transaction details, is accurate and in compliance with applicable laws. BlokDev is not<\/p>\n\n\n\n

responsible for any losses, delays or errors caused by inaccurate or inconsistent information provided by you.<\/p>\n\n\n\n

4. Data protection and privacy<\/strong><\/p>\n\n\n\n

4.1 Collection and use of personal data<\/strong><\/p>\n\n\n\n

By using the Partner Platform and BlokDev services, you consent to the collection, storage and processing of<\/p>\n\n\n\n

your personal data by the Partner Platform and BlokDev in accordance with the General Data Protection<\/p>\n\n\n\n

Regulation (GDPR). The Partner Platform and BlokDev will process your data to facilitate transactions, comply<\/p>\n\n\n\n

with legal obligations and improve the services provided. You have the right to access, correct or delete your<\/p>\n\n\n\n

personal data in accordance with the GDPR. To improve your user experience, the Partner Platform and\/or<\/p>\n\n\n\n

BlokDev may store saved preferences <\/strong>related to your most recently used open banking method. We do not<\/strong><\/p>\n\n\n\n

store your online banking access details. <\/strong>This information is<\/p>\n\n\n\n

used only for pre-filling or offering last<\/p>\n\n\n\n

the option you used.<\/p>\n\n\n\n

4.2 Data security<\/strong><\/p>\n\n\n\n

BlokDev implements appropriate technical and organizational measures to protect your<\/p>\n\n\n\n

personal data and protect it from unauthorized access, disclosure or loss. However, you<\/p>\n\n\n\n

acknowledge that no method of data transmission over the Internet is completely secure<\/p>\n\n\n\n

and BlokDev cannot guarantee the security of data transmitted through the Partner<\/p>\n\n\n\n

Platform. The Partner Platform is responsible for the integrity and<\/p>\n\n\n\n

the security of their systems.<\/p>\n\n\n\n

4.3 Data Breach Notification<\/strong><\/p>\n\n\n\n

In the event of a data security breach, BlockDev will notify the Partner Platform, which will<\/p>\n\n\n\n

in turn notify you in accordance with applicable data protection laws. BlockDev will take<\/p>\n\n\n\n

appropriate measures to mitigate the<\/p>\n\n\n\n

the damages caused by the violation.<\/p>\n\n\n\n

5. Limitation of liability<\/strong><\/p>\n\n\n\n

5.1 BlokDev’s Responsibility<\/strong><\/p>\n\n\n\n

BlokDev is not liable for any direct, indirect, incidental, special<\/p>\n\n\n\n

or consequential damages arising out of or in connection with the use of the Partner Platform or BlokDev<\/p>\n\n\n\n

services, including, but not limited to, financial losses, lost profits, loss of data or unauthorized transactions.<\/p>\n\n\n\n

BlokDev is not responsible for any actions or omissions on the Partner Platform, including,<\/p>\n\n\n\n

but not limited to, delays, errors, technical malfunctions, or fraudulent activities conducted<\/p>\n\n\n\n

through the Platform.<\/p>\n\n\n\n

5.2 No warranty<\/strong><\/p>\n\n\n\n

BlokDev provides the Services “as is” and “as available” without any warranties,<\/p>\n\n\n\n

express, implied or statutory, including, but not limited to, warranties of merchantability, fitness for a particular<\/p>\n\n\n\n

purpose, title, non-infringement or security. BlokDev does not warrant that the Services will be uninterrupted, error-<\/p>\n\n\n\n

free or free of harmful components.<\/p>\n\n\n\n

5.3 Disclaimer<\/strong><\/p>\n\n\n\n

You acknowledge and agree that your use of BlokDev’s services, including all transactions<\/p>\n\n\n\n

initiated through our platform, is subject to the following:<\/p>\n\n\n\n

conditions:<\/p>\n\n\n\n

1. Indemnification: To the extent permitted by law, you agree to indemnify, defend and<\/p>\n\n\n\n

hold harmless BlokDev, its affiliates, directors, employees, agents and<\/p>\n\n\n\n

representatives (collectively, the \u201cIndemnified Parties\u201d) from and against all claims,<\/p>\n\n\n\n

damages, losses, liabilities, penalties, fines, costs and expenses (including<\/p>\n\n\n\n

reasonable attorneys\u2019 fees and court costs) arising out of or<\/p>\n\n\n\n

related to:<\/p>\n\n\n\n

2. Your use or misuse of the Services, including, but not limited to, initiating payments to a Partner or failing<\/p>\n\n\n\n

to make such payments.<\/p>\n\n\n\n

3. Any inaccuracies, errors or omissions in the information or instructions,<\/p>\n\n\n\n

that you provide to BlokDev or its Partners.<\/p>\n\n\n\n

4. Your violation of these Terms and Conditions or any applicable laws, regulations or rules (including, but<\/p>\n\n\n\n

not limited to, those relating to anti-money laundering, fraud or financial regulations).<\/p>\n\n\n\n

5. Any claims brought by third parties, including Partners, resulting from your actions or omissions, whether<\/p>\n\n\n\n

intentional or not, in using the Services.<\/p>\n\n\n\n

6. Any loss or damage caused by unauthorized access to your account, negligence in providing your<\/p>\n\n\n\n

account access details, or failure to notify BlokDev of any suspected unauthorized activity.<\/p>\n\n\n\n

Risk Assumption: You understand and acknowledge that transactions related to<\/p>\n\n\n\n

cryptocurrency, are exposed to significant risks, including, but not limited to:<\/p>\n\n\n\n

a. Market Volatility: Cryptocurrency prices are highly volatile and can change dramatically within short<\/p>\n\n\n\n

periods of time. You assume all risks associated with such price fluctuations and acknowledge that<\/p>\n\n\n\n

BlockDev is not responsible for changes in the value of Cryptocurrencies before, during or<\/p>\n\n\n\n

after your transaction.<\/p>\n\n\n\n

b. Regulatory Risks: The regulatory environment for cryptocurrencies is constantly evolving. You are<\/p>\n\n\n\n

solely responsible for understanding and complying with the laws applicable to your use of the Services<\/p>\n\n\n\n

in your jurisdiction.<\/p>\n\n\n\n

c. Transaction Risks: Transactions made through the Services are irreversible once confirmed. BlokDev<\/p>\n\n\n\n

is not responsible for any losses resulting from incorrect wallet addresses, payment details or other<\/p>\n\n\n\n

errors in your transaction instructions.<\/p>\n\n\n\n

d. Technological Risks: Cryptocurrency transactions rely on blockchain technology, which may be<\/p>\n\n\n\n

subject to delays, errors, or security vulnerabilities. You acknowledge and accept the inherent risks<\/p>\n\n\n\n

associated with blockchain technology, including potential network congestion, smart contract bugs, or<\/p>\n\n\n\n

other technical issues.<\/p>\n\n\n\n

Limitation of liability:<\/p>\n\n\n\n

a. To the maximum extent permitted by applicable law, BlokDev shall not be liable for any indirect,<\/p>\n\n\n\n

incidental, special<\/p>\n\n\n\n

or consequential damages, as well as for loss of profits, revenue, data or reputation arising out of or<\/p>\n\n\n\n

in connection with the use of the Services, whether based on contract, tort (including negligence),<\/p>\n\n\n\n

strict liability or any other legal basis, even if the Company has been advised of the possibility of such<\/p>\n\n\n\n

damages.<\/p>\n\n\n\n

b. BlokDev’s total liability to you for any claims arising out of or related to the Services shall not exceed<\/p>\n\n\n\n

the total amount of fees paid by you to BlokDev in connection with the specific transaction(s) giving<\/p>\n\n\n\n

rise to such liability, or $100, whichever is greater.<\/p>\n\n\n\n

6. Account suspension, termination and deletion<\/strong><\/p>\n\n\n\n

6.1 Suspension and termination of access<\/strong><\/p>\n\n\n\n

BlokDev reserves the right to suspend or terminate your access to its services through the Partner Platform in<\/p>\n\n\n\n

the event of a violation of these Terms and Conditions or illegal activity, including, but not limited to, fraud,<\/p>\n\n\n\n

failure to comply with applicable regulations or misuse of the services. BlokDev reserves the right to terminate<\/p>\n\n\n\n

access in the event of suspicion of money laundering, terrorist financing or other illegal activities.<\/p>\n\n\n\n

6.2 Termination by the user<\/strong><\/p>\n\n\n\n

You may discontinue use of the Services at any time by terminating all transactions and terminating your<\/p>\n\n\n\n

account on the Partner Platform. However, you will remain responsible for any outstanding obligations or<\/p>\n\n\n\n

charges incurred.<\/p>\n\n\n\n

prior to such termination.<\/p>\n\n\n\n

6.3 Effect of termination<\/strong><\/p>\n\n\n\n

Upon termination of your access to BlokDev services, you must cease use of all services and delete any<\/p>\n\n\n\n

confidential information related to BlokDev and the Partner Platform, in accordance with the instructions of the<\/p>\n\n\n\n

Partner Platform. Upon termination of a custody and administration service, BlokDev will take reasonable steps<\/p>\n\n\n\n

to return or transfer the maintained client crypto assets to an eligible address\/wallet specified by the client,<\/p>\n\n\n\n

provided that applicable KYC, AML\/CFT, sanctions, KYT, Travel Rule, security and technical checks are met.<\/p>\n\n\n\n

BlokDev may delay, refuse or block a return or transfer when this occurs.<\/p>\n\n\n\n

required by applicable law, regulatory authority, internal policy or where there is<\/p>\n\n\n\n

suspected fraud, sanction risk, illegal activity, unsupported asset,<\/p>\n\n\n\n

unsupported network, incorrect address or technical impossibility.<\/p>\n\n\n\n

7. Changes to these General Terms and Conditions<\/strong><\/p>\n\n\n\n

7.1 Changes<\/strong><\/p>\n\n\n\n

BlokDev reserves the right to amend or update these Terms and Conditions (T&Cs) at its sole discretion. Any<\/p>\n\n\n\n

changes will be communicated to the Partner by email, and the Partner Platform is responsible for informing<\/p>\n\n\n\n

you, as their client, of such changes. Unless otherwise stated, all changes shall become effective no earlier than<\/p>\n\n\n\n

thirty (30) days after such notification is provided.<\/p>\n\n\n\n

7.2 Right to object<\/strong><\/p>\n\n\n\n

You have the right to object to any proposed amendments to these TOS within thirty (30) days of notice. Such<\/p>\n\n\n\n

objections must be submitted to the Partner Platform without incurring any fees. If<\/p>\n\n\n\n

If you do not object within this period and continue to use the services after the amendments come into effect,<\/p>\n\n\n\n

you will be deemed to have accepted the revised TOS.<\/p>\n\n\n\n

8. Applicable law and dispute resolution<\/strong><\/p>\n\n\n\n

8.1 Applicable law<\/strong><\/p>\n\n\n\n

These General Terms and Conditions (GTC) are governed by Bulgarian law. All disputes arising out of or in<\/p>\n\n\n\n

connection with these GTC shall be resolved in accordance with Bulgarian law. For the avoidance of doubt,<\/p>\n\n\n\n

since you are a client of the Partner Platform, any legal relationship between you and BlokDev is indirect and<\/p>\n\n\n\n

depends on the services provided by the Partner Platform. However, the courts of Bulgaria shall have exclusive<\/p>\n\n\n\n

jurisdiction over all disputes relating to these GTC or BlokDev services.<\/p>\n\n\n\n

8.2 Dispute Resolution<\/strong><\/p>\n\n\n\n

In the event of a dispute, the parties undertake to make good faith efforts to settle it by mutual agreement. If no<\/p>\n\n\n\n

agreement is reached, any dispute arising from or in connection with the services of BlokDev shall be referred<\/p>\n\n\n\n

to the competent court in the Republic of Bulgaria.<\/p>\n\n\n\n

Before taking the dispute to court, you should first raise it with the Partner Platform, which is your direct point of<\/p>\n\n\n\n

contact.<\/p>\n\n\n\n

9. Final provisions<\/strong><\/p>\n\n\n\n

9.1 Invalidity of individual provisions<\/strong><\/p>\n\n\n\n

If any provision of these General Terms and Conditions is held by a court of competent jurisdiction to be<\/p>\n\n\n\n

invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it<\/p>\n\n\n\n

valid and enforceable. If such modification is not possible, the relevant provision shall be deemed severed,<\/p>\n\n\n\n

without affecting the validity and effect of the remaining provisions, which shall remain in full force and effect.<\/p>\n\n\n\n

By using the Services, you expressly agree to these Terms and Conditions and acknowledge that with<\/p>\n\n\n\n

respect to crypto-asset services, BlokDev AD acts as a provider\/principal of the relevant service provided<\/p>\n\n\n\n

through the Partner Platform. The Partner Platform serves as a client interface and technical channel for<\/p>\n\n\n\n

submitting instructions. With respect to payment services, payment accounts, VIBAN, open banking or other<\/p>\n\n\n\n

regulated payment functionalities, BlokDev AD acts only in the applicable capacity, including as an agent of<\/p>\n\n\n\n

a licensed provider, where relevant. BlokDev is not a fiat custody service provider, broker or financial advisor<\/p>\n\n\n\n

and does not assume any fiduciary duties to you or to third parties. Previously provided through the Partner<\/p>\n\n\n\n

Platform, you will receive these Terms and Conditions in the form of a link, by accepting them, you confirm<\/p>\n\n\n\n
